Close to Filing a Chicago Bankruptcy
In Chicago, bankruptcy filings are up considerably in the last year, and especially in the last six months. The economy in Chicago is fairly diversified, but even a diversified economy could not fight back the waves of this perfect economic storm that has affected so many sectors of the economy. Few people thought the downturn would miss the area completely, but it has had a severe effect in Illinois and Chicago. Bankruptcy is a growth industry.
In the last six months the average Chicago bankruptcy lawyer has found that there is no end to the number of people who are coming to them needing help in reorganizing finances. Many individuals and families that end up in the lobby of lawyers are waiting with many of their peers for their proceedings to go forward — either a Chapter 7 or Chapter 13 filing. Chapter 7 will be to liquidate all but exempt assets and Chapter 13 to structure a repayment schedule for most or all creditors.
Many have never retained a lawyer previously, except for a house sale closing. In today’s economic stormy weather it might make sense to do some homework and find a good lawyer, especially if a person’s finances are already distressed and do not seem to be getting better.
There are many sources for finding a good lawyer. Friends and relatives are the best first starting place, followed by researching names and web sites on the internet.
Many things can lead to financial distress. The real estate market in Chicago didn’t up-tick in value as in other places, but there was a bubble, and now that the bubble is burst home prices and values are rapidly decreasing. This has led to many lay offs in real estate and construction and even in retail, where new home buyers typically outfit their new purchases. Add a job loss to a savings loss to homes decreasing in value and top it off with an increase in taxes or a mortgage payment and it is a tidal wave of problems.
Once a lawyer has been retained it makes sense for an individual to be their own best advocate. The lawyer will help, but only within the reality of the case. Each bankruptcy filing is different, involving a different sent of specifics entirely. There is no template, and it’s certainly not a “do-it-yourself” type of action. The courts are involved in bankruptcy filings, so an officer of the court — a lawyer — is needed for the most positive results.
Times are a bit hard in Chicago. Bankruptcy is increasing. Eventually the economy will spring back, and the bankruptcy lawyers who are working between debtors and creditors and the courts will help to make it happen.
